Selling and consignment terms

These terms apply when you sell an item to GEMLUX or consign it with us for sale. We will confirm the route, price and fees in writing before we accept any item.

1. Two ways to sell

  • Sell outright: we make an offer, and once you accept and the item passes our checks, we pay you and the item becomes ours.
  • Consignment: we list and sell the item on your behalf. You remain the owner until it sells, and we pay you the agreed share after the sale.

2. Your promises

You confirm that you own the item and are entitled to sell it, that it is authentic, and that it is not stolen or subject to any finance or claim. We will ask for proof of identity, proof of address and, where available, proof of purchase. Items found to be counterfeit will not be returned and may be reported to the authorities. Items reported stolen will be handed to the police.

3. Authentication

Every item is inspected before it is listed. If an item does not pass our checks, we will tell you and return it at your cost, unless it is counterfeit.

4. Pricing and commission

For consignment, we agree a listing price and a minimum price with you. We will not sell below the minimum without your consent. Our commission is agreed with you in writing before the item is listed.

5. Consignment period

Items are consigned for 90 days unless we agree otherwise in writing. If an item has not sold by then, we will contact you to agree a new price, extend the period or arrange collection. Items not collected within 30 days of our notice may be charged storage at a rate agreed in writing, and if still not collected after a further 60 days, we may treat them as abandoned after giving you written notice.

6. Withdrawing an item

You may withdraw a consigned item before it sells. A withdrawal fee may apply, as agreed in writing before listing.

7. Insurance

Items in our care are insured against loss and damage up to the agreed minimum price.

8. Payment

For consigned items, we pay your share by bank transfer within the period agreed in writing, after the buyer's 14-day cancellation period ends. If the buyer returns the item within that period, it goes back on sale. For outright purchases, we pay once the item has been received and accepted.

9. Law

These terms are governed by the law of England and Wales. Your statutory rights are not affected.
